DMCA Policy

At Christmas Tree Cookies, we respect the intellectual property rights of others and expect our users to do the same. This DMCA Policy outlines our procedures for addressing alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) of 1998.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Christmas Tree Cookies website or service, please notify our designated Copyright Agent as set forth in the DMCA. We will respond expeditiously to remove or disable access to the material claimed to be infringing.

Filing a DMCA Takedown Notice

For your complaint to be valid under the DMCA, you must provide the following information in writing to our Copyright Agent:

  1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work that you claim has been infringed (e.g., a link to your original content or a registration number).
  3. Identification of the material that is claimed to be infringing and where it is located on the Christmas Tree Cookies website/service with sufficient detail that we may find and verify its existence.
  4. Information reasonably sufficient to permit Christmas Tree Cookies to contact you, such as your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
  6. A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Copyright Agent pursuant to Sections 512(g)(2) and (3) of the DMCA. Upon receipt of a valid counter-notification, we may reinstate the material in question.

To be an effective counter-notice under the DMCA, your counter-notification must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Christmas Tree Cookies may be found, and that you will accept service of process from the person who provided the initial DMCA notification or an agent of such person.
  • Your physical or electronic signature.
